TERMS AND CONDITIONS OF USE

1. General Provisions and Ownership

This document constitutes a legally binding contract between the user (hereinafter, the «User» or «You») and the entity owning the web platform, DG Labs (hereinafter, the «Company» or «We»), which operates through the URL https://3d.dglabs.cloud (hereinafter, the «Site» or the «Platform»).

The Platform specializes in providing cloud-based services related to the rendering, visualization, processing, storage and manipulation of three-dimensional (3D) environments and objects, as well as any other software tool or cloud infrastructure provided under said domain.

2. Acceptance of Terms

Use of the Platform attributes User status and implies full and unreserved acceptance of all provisions included in these Terms and Conditions from the moment the User accesses the Site. The Company reserves the right to unilaterally modify, at any time and without prior notice, the presentation, configuration and content of the Platform, as well as these Terms. It is the User's responsibility to periodically review these conditions.

3. Legal Capacity of the User

To be a user of the Platform and to contract, where applicable, the 3D cloud processing and storage services, the User must have the minimum legal age to contract under their local legislation (generally 18 years) or, failing that, have the express consent of their parents or legal guardians. Access and use of the platform is prohibited for persons who do not meet this capacity criterion.

4. Service Description and User Accounts

DG Labs provides a cloud-based technology suite for the 3D ecosystem. This includes, by way of example but not limited to: remote rendering tools, interactive WebGL/WebGPU viewers, mesh file hosting, geometry optimization and API services for integration into third-party software.

4.1 Account Registration and Security

To access certain advanced features or processing quotas of the Platform, the creation of a user account may be required. The User agrees to:

• Provide truthful, accurate, current and complete information during the registration process.
• Maintain the confidentiality of their access credentials (username and password).
• Immediately notify the Company of any unauthorized use of their account or detected technical security breach.

The Company shall not be liable for losses or damages resulting from the User's failure to comply with these obligations.

5. Intellectual and Industrial Property

5.1 Platform Ownership

All intellectual and industrial property rights over the Site, its source code, navigation architecture, databases, 3D rendering and compression algorithms, user interfaces, logos, trademarks, graphics, texts and designs are the exclusive property of the Company or third-party licensors. Their reproduction, distribution, public communication, reverse engineering or transformation without prior written authorization is expressly prohibited.

5.2 User Content Ownership

The User retains all intellectual property rights over the 3D models, files, textures and data they upload, store or process on the Platform (hereinafter, the «User Content»).

By uploading such material, the User grants the Company a worldwide, non-exclusive, royalty-free and sublicensable license strictly limited to what is necessary for the provision of the cloud technical service, which includes reproducing, processing, optimizing, storing, transmitting and rendering such files temporarily or permanently for display within the User's ecosystem.

6. Conditions of Use and Prohibitions

The User agrees to use the Platform in compliance with the law, morality, public order and these Terms. Specifically, the User undertakes NOT to perform the following actions:

1. Upload, process or transmit files that infringe intellectual property rights, patents, trademarks or trade secrets of third parties.
2. Use the cloud storage or rendering infrastructure to host malicious software, viruses, trojans or to carry out denial of service attacks (DoS/DDoS).
3. Engage in scraping, intensive data mining or automated extraction of code or models owned by DG Labs or other users without authorization.
4. Upload material containing illegal explicit representations, unauthorized pornographic content, glorification of violence or hate speech.
5. Attempt to circumvent the quota, bandwidth or processing limitations established by the Site's service plan.

7. Plans, Billing and Cancellation

The Platform may offer free usage models (Freemium) alongside paid subscription plans or consumption-based pricing (pay-per-render/storage per gigabyte). The terms of pricing, billing, payment gateways and automatic renewal will be detailed transparently in the corresponding pricing section of the Platform.

Payments are non-refundable unless the consumer legislation applicable in the User's jurisdiction dictates otherwise on a mandatory basis. Cancellation of a paid plan will prevent automatic renewal of the next billing period, maintaining contracted access until the expiration of the current cycle.

8. Disclaimer of Warranties and Limitation of Liability

The Company makes its best efforts to guarantee the continuous availability of the Platform. However, the services are provided on an «as is» and «as available» basis. DG Labs does not guarantee that the cloud service will be uninterrupted, free of computer errors, free of data loss or completely secure against advanced cyberattacks.

To the maximum extent permitted by applicable law, the Company shall not be liable for:

• Loss of profits, revenue, data, 3D models or indirect damages arising from the use or inability to use the Platform.
• Technical failures arising from the incompatibility of the User's browser with the WebGL, WebGPU or WebAssembly technologies required for three-dimensional rendering.
• Delays or operational deficiencies caused by failures in third-party cloud infrastructure providers (such as AWS, Google Cloud or Microsoft Azure).

9. Privacy Policy and Data Protection

The processing of personal data collected through the Platform (such as email address, metadata of uploaded files and browsing information) is strictly governed by the provisions of our Privacy Policy, available on the Site, complying with the corresponding international standards and the General Data Protection Regulation (GDPR) where applicable.

10. Service Termination

The Company reserves the right to immediately, temporarily or permanently suspend or terminate access to the Platform and cloud tools for any User who breaches the obligations set forth in this agreement, without right to compensation and without prejudice to the legal actions that may correspond to the Company.

11. Applicable Law and Jurisdiction

These Terms and Conditions shall be governed by and interpreted in accordance with the laws in force in the territory of incorporation of the Company that owns the technical service. For the resolution of any dispute or litigation arising from the interpretation, compliance or execution of this contract, the parties agree to submit to the exclusive jurisdiction of the competent courts of the Company's registered address, expressly waiving any other jurisdiction that may correspond to them by reason of their present or future domiciles.
